fa جدول پیشنهادی تعهدات خاص خدمات بانکی ایران در سازمان جهانی تجارت مالیه بین‌الملل (F3) International Finance (F3) مطالعه تجربی Empirical Study <p dir="RTL" style="margin-left:2.0cm;">مهم<span dir="LTR">&lrm;</span>ترین اصول و قواعد سازمان جهانی تجارت در زمینه<span dir="LTR">&lrm;</span>ی تجارت خدمات و از جمله خدمات بانکداری در موافقت<span dir="LTR">&lrm;</span>نامه<span dir="LTR">&lrm;</span>ی عمومی تجارت خدمات (گاتس) تبیین شده<span dir="LTR">&lrm;</span>اند. براساس این موافقت‌نامه، کشورها هنگام الحاق به سازمان می<span dir="LTR">&lrm;</span>توانند با توجه به شرایط خاص حقوقی و اقتصادی خود به آزادسازی تجارت اقدام نمایند. از این رو کشورها موظفند تعهدات خود ذیل موافقت<span dir="LTR">&lrm;</span>نامه<span dir="LTR">&lrm;</span>ی گاتس را در قالب جدول تعهدات خاص به سازمان ارائه دهند. ایران نیز به عنوان عضو ناظر این سازمان، باید گام‌های لازم را جهت تنظیم این جدول بردارد. از این رو در این مقاله با بررسی کلی نظام حقوقی ایران و شناسایی مغایرت<span dir="LTR">&lrm;</span>های آن با اصول گاتس، جدول پیشنهادی تعهدات خاص برای خدمات بانکی ایران ارائه می‌شود. نتایج این مطالعه می<span dir="LTR">&lrm;</span>تواند به مقررات‌گذار و گروه مذاکراتی ایران در فرآیند الحاق به سازمان جهانی تجارت و ایجاد هماهنگی<span dir="LTR">&lrm;</span>های لازم با مقررات این سازمان در حوزه خدمات بانکی کمک کند.</p> <p style="text-align:justify;direction:ltr;unicode-bidi:embed;">The most important regulations of the World Trade Organisation (WTO) on trade in services, including banking, are enunciated in the General Agreement on Trade in Services (GATS). According to this agreement, under the accession process, members could follow trade liberalization based on their economic and legal conditions. Accordingly, they should present their commitments under GATS in the schedule of specific commitments. Iran as an observer member should take the necessary steps for developing the aforementioned schedule, as well. Hence, in this article based on a general survey on Iran legal system and identifying its incompatibilities with the principles of GATS, a schedule of specific commitments on banking services is presented.
