fa چالش‌های اجرایی‌نشدن قرارداد مزارعه در نظام بانکی و بیان راهکار سیاست پولی، بانکداری مرکزی و عرضه پول و اعتبارات (E5) Monetary Policy, Central Banking, and the Supply of Money and Credit (E5) مقاله نظری Theoretical Article قانون عملیات بانکداری بدون ربا بر حمایت از کشاورزی تأکید داشته و مزارعه را یکی از عقود جایگزین در نظام بانکی معرفی کرده است. بانک می‌تواند به‌عنوان یک مؤسسهٔ واسطه بین مالک و کشاورز در تسهیل این امر کمک شایانی کند. مسئله آن است که از ابتدای تصویب قانون بانکداری تا به امروز، این عقد در نظام بانکی اجرا نشده و دلایلی بر اجرایی‌نشدن این قرارداد - باوجود اهمیت فراوان آن - بیان شده که نیازمند تحلیل است. در این مقاله که با روش کتابخانه‌ای تنظیم شده، تلاش شده است با بررسی قرارداد مزارعه، ابتدا آن را از لحاظ فقهی تحلیل کرده و سپس به چالش‌های مطرح‌شده در اجرایی‌نشدن این عقد پرداخته و در ادامه نیز راهکار مناسبی برای حل آن ارائه شود. طرح پیشنهاد واسطه‌گری و ایجاد مزارعهٔ ثانوی برای بانک که موجب می‌شود جایگاه بانک از نقش مزارعی که در قانون کنونی بدان اشاره شده است، به مزارع و عامل در دو قرارداد مزارعه تبدیل شود، ‌ازجملهٔ نوآوری‌های این پژوهش است.<br> &nbsp; <span style="font-size:12.0pt"><span style="line-height:107%"><span kayhan="" style="font-family:" xb="">Agriculture has a special place in the country&#39;s economy. Providing suitable circumstances such as favorable land and air is an important issue that is not easily achieved in all parts of the world. Iran is one of the countries in the world that is very rich in this matter. Accordingly, it is necessary for the officials to do their best to achieve this task better. The Islamic banking law has emphasized this issue and has introduced the share crop agreement as one of the alternative agreements in the banking system. As an intermediary institution between the owner and the farmer, the bank can help greatly in facilitating this matter. The problem is that this agreement has not been implemented in the banking system since the beginning of the approval of the banking law and there are reasons for the non-implementation of this agreement, despite its great importance, which needs to be analyzed. In this paper, which has been prepared with a library research method, an attempt has been made to analyze the cop share agreement first from the point of view of jurisprudence, and then address the challenges raised in the non-execution of this agreement, and then find a suitable solution to solve it.
