Regulatory authority of the Competition Council in Organized commodity markets (Commodity and Energy Exchange)

Abstract:   (54 Views)
The regulatory competence of the Competition Council is among the fundamental issues of Iranian economic law, whose importance has increased with the Council’s growing interventions in various markets, particularly organized commodity market. Based on Article 58(5) of the Law on the Implementation of the General Policies of Principle 44 of the Constitution, the Competition Council considers itself to have general authority to regulate all markets. Such a broad interpretation raises the main question of whether the Competition Council is permitted to regulate markets that have specialized regulatory bodies, such as commodity exchanges? This study adopts a descriptive–analytical method based on library and documentary research, examining the legal foundations and boundaries of the Council’s jurisdiction. The findings suggest that The expansion of the Competition Council's regulatory jurisdiction to organized markets such as commodity and energy exchanges is not only in conflict with the specific laws governing these markets, but is also considered a form of interference in the regulatory powers of self-regulatory organizations. Also, considering the legal capacity of paragraph "2-2", part "e", article 48 of the Seventh Development Plan Law, the Competition Council's jurisdiction is limited to markets with natural monopolies, and in practice, the Competition Council's entry into organized commodity markets where natural monopolies are not relevant lacks legal validity.
